Zana Club PROMOTIONAL PROGRAM RULES
§ 1. General provisions
1. These regulations (hereinafter referred to as the "Regulations") define the rules and conditions for participation in the promotional program for Customers of https://zanacosmetics.com/ called Zana Club (hereinafter referred to as the "Promotional Program").
2. The Organizer of the Promotional Program is Helobrand, a limited liability company, with its registered office in Kraków at ul. Ujastek 1, 31-752 Kraków, entered into the register of entrepreneurs of the National Court Register by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under KRS number 0001076794, NIP (Tax Identification Number) 6793286140, REGON (National Business Registry Number) 527245854, share capital PLN 5,000.00 (hereinafter referred to as the "Organizer").
3. Contact with the Organizer is possible via:

3) by phone – at: +48 789 400 779.
4. The condition for participation in the Promotional Program is prior reading and acceptance of the Regulations.
5. Participants' personal data are processed in accordance with the principles set out in the Privacy Policy.
§ 2. Definitions
1. Capitalized terms used in the Regulations, which are not otherwise defined in the Regulations, have the following meanings:
1) Lilies - points collected by Participants as part of the Promotional Program by making purchases in the Organizer's Store and achieving other goals set by the Organizer, which then entitle them to a discount in the Organizer's Store in accordance with the provisions of the Regulations;
2) Regulations of the Organizer’s Store – regulations specifying the terms and conditions of using the Organizer’s Store, available at: https://zanacosmetics.com/policies/terms-of-service;
3) Organizer's Store – online store run by the Organizer at: https://zanacosmetics.com/;
4) Participant – a person who has met the conditions for participation in the Promotional Program specified in the Regulations or has taken steps to meet them.
2. Capitalized terms used in the Regulations, which are not defined in paragraph 1 above or in the body of the Regulations, have the meaning given to them in the Regulations of the Organizer's Store.
3. In matters not regulated in the Regulations, the provisions of the Organizer's Store Regulations will apply.
§ 3. Participation in the Program
1. The Promotional Program runs from 27/05/2025, 0:00 until further notice.
2. Participation in the Promotional Program is voluntary.
3. The Organizer does not charge Participants any fees for participating in the Promotional Program.
4. Only Participants with a Customer Account may use the Promotional Program.
5. Only a natural person with full legal capacity and who is a Consumer may participate.
6. In order to participate in the Promotional Program, the Participant should perform the following activities during the Promotional Program period:
1) create a Customer Account in the Organizer's Store;
2) check the box next to the declaration of having read the Regulations, the Organizer's Store Regulations and the Privacy Policy and accepting their provisions.
7. The Participant acquires the rights and obligations related to participation in the Promotional Program upon completion of the activities indicated in paragraph 6 above.
8. The Promotional Program does not apply to Customers who make purchases in the Organizer's Store without creating a Customer Account.
§ 4. Lilies
1. The Promotional Program enables Participants who purchase Products offered by the Organizer's Store to obtain and collect lilies.
2. Lilies can be exchanged for discounts in the Organizer's Store in accordance with the provisions of the Regulations. Every 100 lilies obtained by a Participant can be exchanged for a discount of PLN 10.00 to be used in the Organizer's Store.
3. The Participant receives lilies by making purchases in the Organizer's Store - with the exception of the purchase of products excluded from the Promotional Program - as well as by achieving specific goals set by the Organizer, in accordance with the following conversion rate:

for every PLN 1.00 spent in the Organizer's Store - 1 lily
setting up a Customer Account in the Organizer's Store - 100 lilia
Participant's birthday - 250 lilies
newsletter subscription - 100 lilies
anniversary of joining the Promotional Program - 250 lilies
Instagram follow - 50 lilies
Facebook like - 50 lilies
Complete the command - 100 lilies
Add a review of the product - 50 lilies
4. In the case of lilies received in exchange for funds spent in the Organizer's Store as part of purchases made by the Participant, lilies are awarded only for purchases made by Consumers.
5. In the case of lilies received in exchange for cash spent in the Organizer's Store as part of a purchase made by the Participant, lilies are only counted for every full 1 złoty (PLN 1.00) spent during the purchase. The portion of a złoty (PLN 1.00) spent is not counted, and in such a case, the basis for calculation is the gross amount rounded down to the nearest whole złoty.
6. In the case of discounted products, lilies are charged only for the amount actually paid by the Customer (price after discount).
7. The Organizer may also award lilies for Participants performing other activities in the Organizer's Store that are not purchases.
8. Lilies are awarded to the Participant automatically, no later than 30 days after the condition for awarding them specified in the Regulations is met.
9. The Participant's Lily balance is visible in the Customer Account and updates automatically.
10. Lilies cannot be exchanged for cash. Lilies are not electronic money.
11. Lilies are assigned to a specific Account and cannot be transferred to another Participant of the Promotional Program.
12. The participant may not transfer the lily to a third party.
13. If, after purchasing a Product, the Participant exercises the right to withdraw from the Sales Agreement for this Product, the lilies awarded in connection with this purchase are subject to cancellation.
14. The Participant may exchange the obtained lilies for a discount that can be used in the Organizer's Store.
15. The exchange of earned lilies for a discount is made via the Customer Account. After the exchange, the Participant's lily balance will be reduced accordingly by the number of lilies exchanged for the discount.
16. Collected lilies can only be exchanged for a discount when making purchases in the Organizer's Store.
17. The Organizer may periodically award lilies for actions or activities other than those specified in § 4, paragraph 3 above (table), and may also apply special rules for awarding lilies, including in relation to certain products or product groups.
18. The Organizer may conduct periodic point promotions, in particular by granting the Participant a higher number of lilies for purchases of certain Products or for purchases made within a specific period of time than the standard point conversion rate indicated in § 4, paragraph 3 above (table).
19. The Organizer is not responsible for the consequences of using the discount obtained from the lilies by an unauthorized person who came into possession of them for reasons beyond the control of the Organizer.
§ 5. Other benefits for Participants
1. The Organizer is entitled to grant Participants discounts or other benefits other than those indicated in § 4 of the Regulations, without the Participants having to possess and use Lilia.
2. The Organizer is obliged to notify Participants about the granting of benefits referred to in paragraph 1 above by publishing information about the granted benefits in the Organizer's Store.
3. The Organizer reserves the right to grant and withdraw the benefits referred to in paragraph 1 above at any time. However, benefits that have been used by Participants prior to their withdrawal are not subject to withdrawal.
4. The granting or withdrawal of the benefits referred to in paragraph 1 above does not constitute a change to the Regulations.
§ 6. Violations and abuses by the Participant
1. If the Participant is found to have committed any violation of the Regulations or the Regulations of the Organizer's Store, or if there is a reasonable suspicion that the Participant has obtained lilies or other benefits in the Promotional Program in an unauthorized manner, the Organizer is entitled to suspend participation in the Promotional Program or refuse to use the lilies collected by the Participant.
2. Participation in the Promotional Program is suspended for the time necessary to clarify any doubts that may arise, but no longer than 30 days.
3. During the suspension of participation, the Participant may not receive or exchange lilies for discounts or otherwise obtain benefits under the Promotional Program.
4. After clarifying any doubts, the Organizer – depending on the findings made as a result of the explanatory proceedings – may:
1) unblock the Participant's participation in the Promotional Program and, if the suspicion of abuse on the Participant's part turns out to be unfounded, award additional lilies as compensation;
2) unblock the Participant's participation in the Promotional Program, with information that further abuse may result in immediate exclusion from the Promotional Program. In such a case, if the investigation reveals that the Participant's abuse resulted in the accrual of undue Lilies or other benefits, the Organizer will deduct the undue Lilies or other benefits obtained in this manner when unblocking the Participant's participation;
3) exclude the Participant from the Promotional Program with immediate effect, informing him/her of the reason for exclusion.
§ 7. Withdrawal from participation in the Promotional Program
1. A Participant may withdraw from the Promotional Program (terminate the Program participation agreement) at any time, without providing a reason. To do so, the Participant may delete their Customer Account or contact the Organizer.
2. Withdrawal from participation in the Promotional Program is equivalent to deletion of the Customer Account. The Organizer reserves the right to verify the identity of the Customer requesting deletion of their Customer Account.
3. Detailed provisions regarding the Customer Account are available in the Organizer's Store Regulations.
4. Withdrawal from participation in the Promotional Program is equivalent to the Participant losing all lilies unused at the time of withdrawal from participation in the Promotional Program.
§ 8. Complaints
1. If any irregularities are noticed regarding the Promotional Program, the Participant may submit a complaint.
2. Complaints may only be submitted during the Promotional Program and within 7 (seven) days from its end.
3. Complaints may only be submitted via e-mail to the following address:
zana@zanacosmetics.com.
4. The complaint should include:
1) name and surname of the Participant;
2) the Participant's e-mail address;
3) a detailed description of the event that constitutes the basis for the complaint;
4) request for a complaint.
5. Complaints that do not meet the requirements specified in paragraph 4 above will not be considered by the Organizer.
6. The Organizer will consider the complaint within 14 (fourteen) days from the date of its receipt.
7. Complaints are considered on the basis of the provisions of the Regulations and generally applicable law.
8. The Organizer will send the decision regarding the complaint to the e-mail address provided by the Participant in the complaint.
9. The Organizer's decision regarding the complaint is final and not subject to appeal.
§ 9. Dispute resolution
1. The Participant has the option of using out-of-court complaint and claim settlement methods.
2. Detailed information on the Participant's ability to use out-of-court complaint and claim settlement methods and the rules for accessing these procedures are available at the offices and on the websites of:
1) district (municipal) consumer ombudsmen and social organizations whose statutory tasks include consumer protection;
2) Provincial Inspectorates of the Trade Inspection;
3) Office of Competition and Consumer Protection.
3. The Organiser informs that a platform for online dispute resolution between consumers and traders at EU level (ODR platform) is available at http://ec.europa.eu/consumers/odr/.
§ 10. Changes to the Regulations
1. The Organizer may make changes to the Regulations in the event of:
1) changes to the scope of the Organizer's activities;
2) the legal obligation to make changes, including the obligation to adapt the Regulations to the current legal status;
3) preventing violations of the Regulations or counteracting abuse;
4) removing ambiguities or doubts as to the interpretation of the content of the Regulations;
5) extension of the Promotional Program to new communication platforms;
6) changes in the scope of Participants joining the Promotional Program;
7) the Organiser's decision to introduce more favourable conditions for participation in the Promotional Programme for Participants.
2. Changes to the Regulations may not result in the introduction of less favorable conditions for participation in the Promotional Program for Participants.
3. The Organizer shall inform about changes to the Regulations by making the amended version of the Regulations available on the Website and by sending the amended version of the Regulations to Participants via e-mail.
4. A Participant who does not agree to the amendments to the Regulations may, within 7 (seven) days from the date of receipt of the amended version of the Regulations, withdraw from participation in the Promotional Program in the manner indicated in § 7 of the Regulations.
§ 11. End of the Promotional Program
1. The Organizer may terminate the Promotional Program at any time for an important reason, such as:
1) a change in generally applicable legal provisions having a direct impact on the Promotional Program and resulting in the necessity of its termination;
2) economic unprofitability of the Program;
3) issuance of a judgment or decision by a court or authorized public authority concerning the Program and resulting in the necessity to terminate it;
4) introducing other forms of promotional and marketing activities concerning the Organizer or the Organizer's Store in place of the Program.
2. The Organizer will notify Participants about the end of the Promotional Program, indicating the date of the end of the Promotional Program, but this date cannot be earlier than 14 (fourteen) days from the date of sending the notification of the end of the Promotional Program.
3. After the end of the Promotional Program, the Organizer suspends the awarding of lilies and any other benefits.
4. The Participant may use the Lilies and any other benefits accumulated by the end of the Promotional Program for a period of two months following the end of the Promotional Program. After the deadline referred to in the preceding sentence, any unused Lilies and any other benefits will be forfeited.
§ 12. Final provisions
1. The law applicable to the Regulations is Polish law.
2. The current version of the Regulations is effective from 27/05/2025.
